Analysis: At peak of powers, Merkel sets sights on third term

BERLIN (Reuters) - In Germany, election campaigns are supposed to be all about parties, policies and platforms, most definitely not personalities. Now that is about to change.

Angela Merkel, at the peak of her political powers, is gearing up to run for a third term and what she hopes will be a place in the history books alongside towering post-war German leaders like Konrad Adenauer and Helmut Kohl.

Next week, her conservative Christian Democratic Union (CDU) will informally kick off the campaign with a two-day congress in the northern city of Hanover that is shaping up as a very un-German affair -- a Merkel-centered love-fest similar in style and spectacle to a U.S. presidential convention.

Seven years into her chancellorship, a point when her predecessors Gerhard Schroeder and Kohl were struggling with poor poll ratings, the 58-year-old Lutheran pastor's daughter from East Germany is as popular as ever.

Two in three Germans say she is doing a good job, according to surveys, and many now applaud her handling of the euro zone crisis, where she has performed a stunning feat -- keeping the single currency intact with one policy concession after another, yet still managing to be seen as a staunch defender of German interests.

Criticized early on for her cautious leadership style, Merkel's low-key approach is now hailed by many as positive in a time of turmoil.

"The CDU's main asset in this election is Frau Merkel," said Environment Minister and party ally Peter Altmaier. "She enjoys a huge amount of trust. She has no rivals and is the most popular politician in the country."

A close aide to Merkel who will have a role in shaping her re-election strategy was even more clear: "Of course we will focus this campaign on the chancellor. We'd be stupid not to."

A heavy dose of adulation has been programmed into the congress in Hanover. Delegates have only one main task, a member of the CDU executive committee told German weekly Der Spiegel: "They are to give Angela Merkel a standing ovation of at least seven minutes after her speech."

KINDER, KUECHE, KIRCHE

Still, it would be wrong to assume total harmony within the party, even if that is the message Merkel and her allies are trying to send.

Since taking power in 2005, the chancellor has pushed her party in an entirely new direction. Not all in the CDU are happy about that.

After fighting for years against a minimum wage, the party now officially supports one. And after condemning the nuclear power phase-out introduced by Schroeder's centre-left government, Merkel now says it did not go far or fast enough. Last year she shocked her party with her "Energiewende", or energy revolution, that pushes Germany out of nuclear and into renewables at alarming speed.

On social issues there is also grumbling. The CDU's approach towards women used to be summed up with three simple words: "Kinder, Kueche, Kirche", or children, kitchen, church. Now it is pushing for more childcare spots so that mothers can work and is debating the idea of imposing quotas on businesses to boost the number of women in top positions.

"We need to watch out that in our search for two new voters, we don't lose three old ones," says Wolfgang Bosbach, a senior CDU lawmaker who has clashed with Merkel in recent years.

Other controversial social issues, including a divisive debate about tax treatment of gay couples, are being swept under the table in Hanover in the name of unity.

"The truth is that Merkel has no interest in seeing a big debate on the issues. This congress is supposed to show that the party is fully behind the chancellor and her government," said Frank Decker, a political scientist at Bonn University.

"The CDU is having to appeal to a broader base, to adapt to a changed reality in society, new family structures and a bigger role for women," he added. "A traditional conservative, Christian party must find answers, it must debate these things. But Merkel is refusing to allow this debate to happen, and that breeds resentment."

NO GUARANTEES

In modernizing the CDU, Merkel has made it all but indistinguishable from the other big parties, the Social Democrats and Greens. By design or not, this has made the party even more dependent on Merkel for its identity.

So far that has not been a problem. The CDU and its Bavarian sister party, the Christian Social Union (CSU), have a comfortable 10 point lead over the next biggest party, the SPD, 10 months before the federal vote.

Working in Merkel and her party's favor has been the disastrous start of her SPD challenger Peer Steinbrueck, who has been dogged by a row over lucrative speaking engagements since he was anointed two months ago.

Still, it would be wrong to assume Merkel's re-election is guaranteed.

The euro zone crisis remains perhaps the biggest risk, as the domestic backlash against her latest aid deal for Greece showed this week.

If Greece's financial problems flare up again before the German election, she is bound to come under fire for cynically delaying a lasting solution to the country's debt woes until after the vote out of fears for her own political future.

An economic slowdown at home could also weigh on her popularity. Hit by weakness in its trading partners, the German economy is expected to contract in the fourth quarter of 2012 and data on Thursday showed unemployment rising for the eighth month in a row.

Perhaps a bigger risk is the shifting party landscape in Germany, notably the collapse of the CDU's traditional partner, the Free Democrats (FDP), with whom Merkel rules in Berlin.

The consequences of this could be felt as soon as January, when Lower Saxony, the German swing-state equivalent of Ohio, holds an election.

Loyal Merkel ally David McAllister, a half-Scot who runs the state, is expected to come out on top in the vote, but may still be booted out of office by a coalition of the SPD and Greens if the FDP fails to make it into the state assembly.

That result would send a worrying signal to the CDU faithful.

"Lower Saxony will help shape the mood for the election year," Michael Meister, a senior CDU lawmaker told Reuters. "There will be a result, and it will carry a message."

Regardless of what happens in Lower Saxony, people close to the chancellor say she cannot rest on her laurels, but must make a convincing case about where she wants to take Germany.

"The big question will be, why again?" her close aide said. "People vote for the future not the past."

Asked what she hoped to accomplish in a third term, the aide pointed to four areas: bringing stability to the euro zone; bedding down her energy revolution; consolidating the budget; and ensuring continued growth and prosperity.

Gero Neugebauer, a political scientist at Berlin's Free University, puts Merkel's chances of winning re-election next year at just 50-50 because the FDP's slide has left her without a "Machtoption", or hope of a majority with her current partner.

Others see it differently. By moving ever closer to the SPD and Greens on policy, Merkel has given the CDU more coalition options, notes Josef Joffe, publisher-editor of German weekly Die Zeit.

"She can go with a revived FDP, with Steinbrueck's SPD and, if the Greens are hungry enough, with them as well," he says, putting her chances at "close to 100 percent".

"She represents the 'good shepherd' in turbulent times. Somehow, people believe, she will get them through the mess safe and sound."

The banks, BFA/Bankia, NCG, Catalunya Bank and Banco de Valencia, are expected to implement thousands of layoffs as part of one of the EC?s requirements for restructuring. The funds will be disbursed by the European Stability Mechanism, ?a permanent international financial institution that assists in preserving the financial stability of the European Union monetary union by providing temporary stability support to euro area Member States.? The restructuring/funding initiative will lead to the? integration of Banco de Valencia into Caixabank, and a cut in the balance sheet of each of BFA/Bankia, NCG, and Catalunya Bank by more than 60 percent over the next five years.   • BP has been temporarily suspended from further federal contracting by the U.S. Environmental Protection Agency.? The move comes after the EPA expressed concern that BP exhibited a lack of business integrity after the Deepwater Horizons oil platform explosion and subsequent oil spill that led to mass-scale pollution throughout the Gulf of Mexico in 2010.? Earlier this month, BP agreed to pay US $4.5 billion in connection with a guilty plea to criminal charges that arose out of the environmental disaster. The EPA said the suspension was ?standard practice when a criminal case raises responsibility questions about a company.?? Some have expressed the concern that the ?suspension could threaten BP?s dominance in the Gulf of Mexico where it is one of the largest producers of oil and natural gas and ? hamper BP?s ability to maintain its position as a top supplier of jet fuel and other refined products to the U.S. military.? Coupling these concerns with the fact that there does not appear to be a set timetable for when the suspension will be lifted, one might expect to see an impact on the per share price of BP stock. But, through Wednesday afternoon, the per share price did not appear to be materially affected.
  • Smith & Nephew is set to acquire substantially all of the assets of Healthpoint Biotherapeutics, a business that is involved with bioactive debridement, dermal repair and regeneration wound care treatments.? According to Smith & Nephew CEO Olivier Bohuon, the acquisition, which carries a purchase price of US $782 million, gives Smith & Nephew a ?strong position in the fast growing area of bioactive wound care treatment.? ?The global advanced wound care market was estimated to be $6.7 billion in 2011? and is expected to experience continued growth into the next decade.
  • John Lechleiter, who is both the Chairman of the industry group Pharmaceutical Research and Manufacturers of America (PhaRMA) and the CEO of Eli Lilly & Co., is meeting with officials of the Chinese government on behalf of the industry group. The meetings will include discussions about how to make the drug approval process in China more efficient. Currently, ?China takes eight years longer on average to approve drugs than other major countries and U.S. drugmakers are looking at ways to help speed things up.?? With the ?world?s fastest-growing pharmaceuticals market,? China is a target of companies like Eli Lilly for operational and research expansion. That company ?itself plans to conduct simultaneous late-stage tests in China for products,? with the five year goal being the introduction of more than a dozen products, and the shorter term objective being a continuation of its recent annual trend of growth of 25% in sales in that country.

Read all about it: Pope has not cancelled Christmas

VATICAN CITY (Reuters) - And so it came to pass that in the eighth year of Pope Benedict's reign, some tabloid and social media decreed that he had cancelled Christmas.

The day after Benedict's latest book "The Infancy Narratives - Jesus of Nazareth" - was published on November 20, Vatican officials found some headlines they were not expecting.

"Killjoy pope crushes Christmas nativity traditions," read one tabloid headline, claiming that Benedict had snubbed traditions such as animals in nativity scenes and caroling.

"Pope sets out to debunk Christmas myths," ran another.

Holy Scrooge! Some blogs unceremoniously branded Benedict the new Grinch that stole Christmas and one rocketed him to the "top of the grumpy list for 2012."

And then there was this zinger headline from a web news site: "Pope bans Christmas".

Coming little more than a month before Christmas, it was the last thing the Vatican needed - another image problem for the pope.

Alarmed by some of the headlines, the Catholic social network XT3 felt compelled to run a blog that dissected the media's coverage of the book.

It was headlined: "The pope has not banned Christmas".

So what was all the fuss about?

In the 137-page book, the pope states a fact: that in the gospels there is "no reference" to the presence of animals in the stable - actually, it was probably a cave - where Jesus was born.

Bloggers had a feast with that, with one calling it "Bombshell number one".

What some neglected was that just a few sentences down, the pope states that even today, "No representation of the crib is complete without the ox and the ass".

He explains: The tradition of the ass and ox came from reflecting on parts of the Old and New Testaments. Christian iconography then adopted the motif early in Church history to show that even animals knew Jesus was the son of God.

KEEP ON CAROLLING

In other words, the tradition that has developed over the centuries matters more than an unverifiable fact, at least as far as the case of the ox and ass in the stable is concerned.

"I think that what people need to realize here is that the pope is trying to be as historical as he can be," said Father Robert Dodaro, professor of patristics, or the study of early Church writings, at Rome's Patristic Institute.

"He wants to see the biblical narratives as history where possible but he is also trying to explain details in the narratives that cannot be historically verified," he said.

Some bloggers, taking their cue from television and website headlines, even wrote that the pope had spoken out against Christmas carols.

In the book, the opposite was true.

Benedict says the evangelist Luke wrote that at the moment of Jesus' birth the angels "said" the well-known phrase "Glory to God in the highest, and on earth peace among men with whom he is pleased".

But in the next line he explains that "Christianity has always understood that the speech of angels is actually song", that "the angels' song of praise has never gone silent", and that it is "only natural that simple believers (even today) join in their caroling on the Holy Night".

So, no need to cancel any school performances.

Another section of the book that irked some bloggers is where the pope restates what biblical scholars have known for decades, if not centuries - that Jesus was born several years earlier than the first century AD.

Benedict writes that since King Herod died in 4 BC, Jesus was probably born "a few years earlier". He attributes the erroneous fixing of the year of Jesus' birth to a miscalculation by the monk Dionysius Exiguous some 500 years later.

"No one's faith should be shaken by this book," said Dodaro. "On the contrary, it should be fortified by this account. This is a believable account of the birth of Christ," he said.

And in St Peter's Square, workmen have started building the Vatican's larger than life nativity scene, which is expected to have animals and singing angels.

The Alternative History of Mitt Romney's Campaign, by a Man Who Brought It Down

Mitt Romney's campaign manager Stuart Stevens has offered up a weird counter-history of the 2012 presidential election, the you might imagine coming from lefties like Howard Zinn or Oliver Stone ? if the purpose weren't to protect the reputation of a former private-equity executive. In defending Romney, Stevens is also defending himself, because he was frequently attacked by conservatives in the last few months of the campaign for being in over his head. Let's look at Stevens's interpretation of history,?from The Washington Post today:

I appreciate that Mitt Romney was never a favorite of D.C.?s Green Room crowd or, frankly, of many politicians. That?s why, a year ago, so few of those people thought he would win the nomination... Nobody liked Romney except voters.

Many pundits expected Romney to win the nomination ? it was the doubters who were outliers. Many of the candidates running against him had lackluster resumes, and his more serious challengers ?dropped out early (Tim Pawlenty) or failed to catch on (Jon Huntsman). By late November 2011, Romney was almost a sure thing, because even though Herman Cain had been polling ahead of him, his most serious remaining challenger, Rick Perry, had blown up at the debates. And the idea that only voters loved Romney is contradicted by Stevens himself three sentences later!

[Romney] bested the competition in debates, and though he was behind almost every candidate in the primary at one time or the other, he won the nomination and came very close to winning the presidency.

Yes, that's right, voters were so enamored with Romney that he polled behind Herman Cain. Not to mention a former speaker of the House who'd been out of office 14 years, a former senator who was defeated six years earlier, and a Minnesota representative who once called for an investigation into the true sympathies of members of Congress.

[Romney] raised more money for the Republican Party than the Republican Party did.

As Obama did for the Democrats, Romney raised money for the Romney Victory Fund, which allows donors to give to the campaign, the national party committee, and the state parties in one check. That check maxes out at $75,800 per person. But only $5,000 can go directly to the campaign, and that's all the campaign had direct control over. Romney had a higher average donation and fewer total donors than Obama did.

When much of what passes for a political intelligentsia these days predicted that the selection of Rep. Paul Ryan meant certain death on the third rail of Medicare and Social Security, Mitt Romney brought the fight to the Democrats and made the rational, persuasive case for entitlement reform that conservatives have so desperately needed...?And it?s safe to say that the entitlement discussion will never be the same.

Romney attacked Obama for?cutting Medicare, not for spending too much on it. And polls showed those attacks worked. It didn't change the entitlement discussion -- it was a replay.

In the debates and in sweeping rallies across the country, Mitt Romney captured the imagination of millions of Americans.

At left is a word association chart from a poll by Pew Research Center. It shows the Obama campaign ? and allied super PACs ? were somewhat successful in shaping how voters imagined Romney.

When Mitt Romney stood on stage with Barack Obama, it wasn?t about television ads or whiz- bang turnout technologies, it was about fundamental Republican ideas versus fundamental Democratic ideas. It was about lower taxes or higher taxes, less government or more government, more freedom or less freedom. And Republican ideals ? Mitt Romney ? carried the day.

But, obviously, not on Election Day.

How to Avoid a Clogged Bathtub DrainWe've shown you how to unclog a stopped drain, but why solve the problem when you can stop it before it starts? Keeping water flowing through your drain is actually pretty easy with a tiny bit of monthly maintenance.

Preventing drain clogs involves very little work. Instead of spending excessive time and effort whenever the thing gets backed up, you just exert a fraction of that effort on a monthly (or, in more extreme situations, bi-monthly) basis. For many people, that effort is nothing more than pouring a gallon of hot/boiling water down your drain. This helps loosen and hair or gunk clogging the main pathway and push down. After you do this, be sure to run regular warm water for about five minutes just to continue pushing everything as far down and out as you can get it.

If that doesn't work, chances are you produce a lot of hair and that hair is long. This is where a hair catcher comes in. For about $5-10 you get a little device that sits in your drain and catches hair and gunk. Gross, yes, but you just empty it once or twice a month and your drain will never clog.

Unfortunately there isn't any way to send everything that goes down the drain into another dimension and magically solve the problem, but if you employ these two tips you'll at least avoid the problem.

Hosting holiday parties can be great fun and is a wonderful way to gather your friends and family to enjoy time together. But how do you help ensure your efforts pay off and your guests enjoy themselves (and get plenty of good food to eat)? I?ve come up with five tips (not coincidentally, using PARTY as an acronym!) to help you on your way to hosting a successful party, gluten-free or otherwise!

P lan. As the years go by and I host more and more parties, I do this more and more. In order to save sanity, planning is essential. Write it all down. Start a grocery list, and make a schedule. Write down all preparation tasks ? everything from making tasty appetizers, to ironing tablecloths, and putting up decorations. A good, written plan will keep you from running around panicked.

A sk for assistance. My family and friends often know I tend to want to do it all, and when it comes to food, make it all from scratch, especially since food allergies are front-and-center in my home. News flash: you don?t have to do it all! Ask others to help by bringing something or coming over early to help you set up. If there are a few ready-made items that fit into your plan, such as gluten-free crackers for hors d?oeuvres, then take advantage of them. You don?t have to be Martha Stewart to pull off a unique and successful party! And if you have a Breville Smart Oven (I?d love it if Santa brought me one this Christmas), you can relax knowing your timing spaced out perfectly ? and things will be done faster! I can?t think of better assistance than that!

R emember how much space you have. If you are hosting in your home, and you don?t have but about 100 square feet of space for the party, you can?t invite everyone you know. Keep it to 20-25 people. You don?t want everyone rubbing elbows. Also, there is no rule that says everyone must sit down to a formal dinner in order to have a good time at your holiday party. If you have more guests than places at the table, why not instead lay out lots of hors d?oeuvres on the table and make it a standing-room party?

T hink about the needs of your guests. People have different tastes and different needs when it comes to food. Check with guests about food allergies and preferences, and then plan a well-rounded menu that ensures there is a little something for everyone ? gluten-free, dairy-free, vegan, carnivore, etc. This needn?t be complicated. Check out the list of recipes at the end of this post for ideas.

Y ou don?t have to go all out. There?s no need for the most expensive champagne, a full bar, and high-end treats for everyone. Make a reasonable budget and stick to it. Often times, sticking to ingredients in your dishes that are easy to find, mainstream, and naturally gluten-free can keep you from emptying your pocketbook at the grocery. Dips are always a hit and can stretch your dollar. Spice things up with interesting dippers, such as a variety of colorful and nicely sliced vegetables, or even scoop it onto endive leaves for a pretty presentation. A successful party doesn?t have to put you in the poorhouse!

Former "American Idol" judge Steven Tyler is sorry that Nicki Minaj found comments he made about her to be racist. "I apologize if it was taken wrong, Nicki," the Aerosmith rocker said Tuesday on eTalk, a Canadian entertainment show.

"But I am the farthest from (being a racist)," he said. "I am the last thing on this planet as far as being a racist. I don't know where she got that out of me saying I'm not sure how she would've judged Bob Dylan."

Minaj was outraged after Tyler told MTV he thought the "Starships" singer "would have sent (Dylan) to the cornfield" if he'd come on "Idol." But Tyler insisted he only meant, "if Bob Dylan came on the show, he would've been thrown off."

"Maybe I spoke out of turn," he said. "But a racist I'm not, Nicki."

(AP) ? Lynne Jones' cozy bed and breakfast in Britain's Lake District boasts views over the River Greta where heron come to feed, and a panoramic vista of Skiddaw mountain.

Jones says her B&B has another virtue: It's practically watertight. In an island nation where some 920 homes have flooded and at least three people have died in the past few days, that's saying something.

"It's almost an ark," she said. "Short of actually letting it float, we've done everything we can to protect it."

But the floodgates and other fixtures Jones installed haven't led to lower insurance premiums. And things may get worse, as the British government and British insurers battle over a deal that would provide state guarantees for flood coverage at a time when losses are expected to rise because of global warming.

With more storms on the way, the government and the insurance industry are engaged in mutual finger-pointing. Insurers say the government is failing to provide homeowners the type of guarantees that other European countries and the U.S. do, while the government is accusing the industry of whipping up people's fears by publicizing its negotiating position even before flood waters have receded.

If a deal isn't struck by the end of June, as many as 200,000 people in Britain could either lose their insurance or find it too expensive to pay premiums that are certain to rise without government guarantees.

All this comes as the European Environment Agency reported that global warming has caused an overall rise in sea levels globally and along most of the region's coasts. There has also been an increase in flooding along streams and rivers.

Floods and storms account for around two-thirds of the costs for natural disasters, the agency concluded. And those costs continue to rise.

"The contribution of climate change to the damage costs from natural disasters is expected to increase in the future due to the projected increase in the intensity and frequency of extreme weather," the report said.

Mindful of the trend, British insurers want to place a surcharge on all insurance premiums to create a new funding pot to cover flooding claims. But until that fund is built up, they want the government to back a temporary overdraft to cover any shortfalls during periods of intense flooding. So far, there's no deal, and people watching floodwaters rise across the country have become uneasy.

"Negotiations have hit an impasse," Nick Starling, the director of general insurance at the Association of British Insurers said in a statement. "Insurers know their customers are increasingly worried about flood cover and we will therefore continue talks with government to try and find a way forward."

The government says the door is still open to an agreement, but declined to get into the specifics. But it did take time to criticize the timing of the industry's announcement, coming as heavy rains swept across the country and forced the evacuations of hundreds of homes.

Environment Secretary Owen Paterson said raising the issue of insurance was causing alarm unnecessarily.

"I think the timing was unhelpful," he told BBC on Monday. "There are a lot of people across the country who are going to face some very bad weather over the next few days. Many people are extremely worried, and I think it is not helpful to alarm people when we are in close, detailed negotiations."

Prime Minister David Cameron raced to flooded areas Tuesday to underscore his concern. But with images of furniture floating down streets and cars lurching in torrents of mud, the argument that more needs to be done to help people recover is tough to ignore.

Governments around the world have responded to the problem of flooding in different ways. In Germany, coverage for flooding is offered as an optional add-on for household insurance with some 30 percent who need it going to private insurers ? although the state has stepped in to help after big disasters. In the United States, the government partly backs flood insurance for high risk households, as does France, the insurers' group said.

In the Netherlands, home of the legendary boy who held back floodwaters by placing his finger in a dike, flood risk is normally excluded from property insurance policies due to the high potential loss. The Dutch state will pay compensation under some circumstances to those suffering losses that the market does not insure, though there are limits.

The National Flood Forum, a U.K. charity that represents people who are at risk of flooding, hopes that the latest troubles will finally persuade ministers and the industry to strike a deal. Talks on a plan have been going on for years and without an agreement people will struggle to get insurance and to deal with the consequences, said Paul Cobbing, the group's chief executive officer.

"The floods that have happened in the last few days are the perfect illustration of why insurance is so important," Cobbing said. "It saves families from ruin."

Homeowners like Jones, 59, from the town of Keswick in Cumbria, want the government and insurers to settle their differences ? for the benefit of the people and their piece of mind. She urged homeowners to learn their rights ? particularly in terms of what they can ask of insurance companies when they pay claims.

A lot, she says, can be wrapped up in one piece of real estate.

"It's our home. It's our business," she said. "It's our children's inheritance."

FDA suspends operations at peanut butter plant

(AP) ? The Food and Drug Administration is cracking down on a New Mexico peanut butter plant that had repeated food safety violations over several years, using new authority to halt operations at facilities that may be producing unsafe food.

The agency on Monday suspended the registration of Sunland Inc., which is the country's largest organic peanut butter processor. FDA officials found salmonella in numerous locations in Sunland's processing plant after 41 people in 20 states, most of them children, were sickened by peanut butter manufactured at the Portales, N.M., plant and sold at the Trader Joe's grocery chain. The company had announced plans to reopen its peanut processing facility on Tuesday after voluntarily shutting down earlier this fall.

The FDA gained the new authority to suspend companies' registrations in a food safety law signed by President Barack Obama in early 2011, and this is the first time the agency has used it. The ability to shut down the company's operations is a step forward in an FDA effort to stem a growing number of widespread outbreaks like the salmonella illnesses linked to the peanut butter, said Michael Taylor, the FDA's deputy commissioner for foods.

Before the food safety law was enacted, the FDA would have had to go to court to suspend a company's registration.

"We would have had to go to court and build a case," Taylor said, stressing that the burden will now be on the company to prove it is safe.

Sunland had closed its peanut processing facility after the September outbreak. It planned to reopen this week with hopes of selling peanut butter again by the end of the year. Sunland spokeswoman Katalin Coburn said the FDA's decision to suspend the registration was a surprise to the company and Sunland officials had assumed they would be allowed to resume operations.

The company now has the right to a hearing and must prove to the agency that its facilities are clean enough to reopen. Coburn said Sunland is cooperating with the FDA and company officials hope they can be operating again soon.

Besides organic peanut butter, Sunland also produces many non-organic products. The company recalled hundreds of organic and non-organic nut butters and nuts manufactured since 2010 after Trader Joe's Valencia Creamy Peanut Butter was linked to the salmonella illnesses in September.

In addition to Trader Joe's, Sunland sold hundreds of different peanut products to Target, Safeway, Whole Foods and other large grocery chains. Many of the grocery stores repackaged Sunland products and sold them under their own names.

After the outbreak linked to Sunland and to Trader Joe's, FDA inspectors found samples of salmonella in 28 different locations in the plant, in 13 nut butter samples and in one sample of raw peanuts.

The agency also found improper handling of products, unclean equipment and uncovered trailers of peanuts that were exposed to rain and birds outside the facility.

The FDA said that over the past three years, the company shipped products even though portions of their lots, or daily production runs, tested positive for salmonella in internal tests. The agency also found that the internal tests failed to find salmonella when it was present.

FDA inspectors found many of the same problems, including employees putting their bare fingers in empty jars before they were filled, open bags of ingredients, unclean equipment and many other violations, in a 2007 inspection. Similar issues were recorded by inspectors in 2009, 2010 and 2011, although government officials didn't take any action or release the results of those inspections until after the illnesses were discovered this year.

In a statement issued earlier this month, Sunland's president and chief executive officer, Jimmie Shearer, denied the company knowingly shipped tainted products.

"At no time in its 24-year history has Sunland Inc. released for distribution any products that it knew to be potentially contaminated with harmful microorganisms," Shearer said in a statement posted on the company's website. "In every instance where test results indicated the presence of a contaminant, the implicated product was destroyed and not released for distribution."

A separate peanut butter outbreak in 2009, not related to Sunland, was linked to hundreds of illnesses and nine deaths.

Study links improved consumer welfare to increased prescription drug advertising efforts

ScienceDaily (Nov. 26, 2012) ? More people are better off thanks to the impact of an influx of direct-to-consumer advertising spending than they would be without those marketing efforts, according to a study recently published by Jayani Jayawardhana, an assistant professor in the University of Georgia College of Public Health.

The multi-year study focused on advertising efforts surrounding cholesterol-reducing prescription medications. Jayawardhana found increased levels of consumer welfare due to direct-to-consumer advertising than when compared to situations without this type of marketing. Her research, which was published in the International Journal of Industrial Organization, concludes that such efforts also spurred under-diagnosed patients to seek medical treatment.

Federal deregulation of prescription drug marketing in 1997 lowered cost barriers and enabled manufacturers to advertise prescription drugs without including a detailed summary of the product. Since the relaxation of those rules, advertising spending from pharmaceutical companies has increased by more than 200 percent.

Jayawardhana, a health economist in the college's department of health policy and management, said her study was the first to provide an analysis of consumer welfare that demonstrated a connection to the increased marketing expenditures. It also adds further support to existing academic research suggesting that direct-to-consumer advertising efforts lead to a more informed and more inquisitive consumer, which could lead to better health outcomes.

"Let's say you see a commercial for Lipitor, and you suspect that you have high cholesterol, so you come and ask for that drug from the physician," Jayawardhana said. "For whatever reason, the doctor may assume that isn't the best drug for you, and you get prescribed Zocor instead. The point isn't that you didn't get the drug you saw on the commercial but rather that you came to the doctor and got treatment for your condition, which leads to welfare improvement."

Because of the role of physician in the decision-making process, pharmaceutical companies have to market their drugs to the two purchasing agents involved -- the consumer and the physician.

"When you see an advertisement for something like Coke, the intent is to give you an incentive to go buy the product," she said. "But with the prescription drug market, the consumer is not the final decision maker. You have to go through a gatekeeper in the physician."

Jayawardhana's research indicates those advertising efforts-to both consumers and physicians-are paying off. In addition to heightened consumer awareness, targeted advertising toward physicians has both an informative and persuasive effect on the selection of the drug.

Jayawardhana, who holds master's and doctoral degrees in economics from the University of Virginia, said critics of the federal deregulation have suggested the marketing spending boom could lead to a myriad of harmful results-such as patients requesting and receiving inappropriate drugs or higher dosages than necessary from their physician.

While such incidents may be possible, it is difficult to recognize such outcomes in the data. However, because physicians act as gatekeepers for prescription drugs and consumers have limited access to advertised products, such negative outcomes may be scarce, she said.

Most relationships ? most fairy tales ? most marriages ? are built on a need to own another person, on a desire to control the actions of another, on a conditional premise which is based on reliance and not on a true ENHANCEMENT.

A relationship built on EQUALITY and ENHANCEMENT ? does not need to be labeled, it does not need to be co-dependent, it does not require lifelong conditions or ceremonies, it clearly requires two individuals who are extremely capable alone and who come together to create something even better.

How is a relationship built on EQUALITY and ENHANCEMENT??

If I play tennis with a seven year old, I have to tap the ball over the net, I have to make sure that the ball is placed close to the player, I have to lessen my game in order that the seven year old might possibly perhaps hit the ball back over the net (even though he will probably smack it into the net, out of the court, or at my head), and therefore the game of tennis I play is not much fun for me, in fact it quickly becomes a chore as I lower my standards more and more to accommodate the abilities of a seven year old (or lack thereof).

However, if I were to play against someone who is better than or equal to my playing standard, I have to raise my game in order that the rallies are fun and exciting, in order to keep up the enjoyment of each player, in order to be equal to the partner I am playing with. When I play tennis with this person I have met my match, I am constantly thinking, strategizing, excelling, increasing my performance to keep the game alive and thriving, and by the end of the set I have become a better player (as have they) because we each gave it our all, and we each took what was offered in the spirit it was intended.

The moral of the story is that you never need to lower your standards to accommodate someone else?s relationship issues.

?

Certainly, you need to communicate and work together, yet you never need to compromise your abilities to be in a relationship with someone who is not capable of matching you with theirs.

Virgin and Qantas neck and neck in domestic leisure air travel

The latest Roy Morgan Air Travel Report for October 2012 shows 38.8% of Australians used Virgin Australia on their last domestic holiday or leisure trip, and 38.4% used Qantas.

Jetstar is gaining ground in the domestic leisure market, with the October 2012 results showing that 36.0% of Australians used Jetstar on their last domestic holiday or leisure trip, up from 32.5% in October 2011.

Some 5.4% of Australians used Tiger Airways according to the October 2012 report. This is down from 8.1% in October 2011.

Jane Ianniello, International Director of Tourism, Travel & Leisure, Roy Morgan Research, says:

?Virgin Australia is being seriously challenged by the Qantas group in the domestic leisure market. Jetstar has been able to grow its share of the market by positioning itself as a discount airline and appealing to the budget conscious air traveller.

?However, Virgin Australia is fighting back, having recently announced that it is seeking to take a 60% stake in the discount carrier Tiger Airways. Virgin Australia and Tiger Airways plan to jointly spend $62.5 million to boost the Tiger fleet from 11 aircraft to 35 over six years.

?The Roy Morgan data shows there are distinctly different profiles for business travellers, leisure travellers, and budget air travellers.

?It is important for airlines to understand these demographics, attitudes and behavioural nuances so as to position their brands and tailor appropriate messages to entice travellers to choose to fly with them.?

'Fiscal cliff' talks loom over Wall Street

Holiday shopping could be a bright spot for the stock market, but both could soon stall if lawmakers don't make progress on the ?fiscal cliff? when they return in the coming week.

Congressional leaders and President Barack Obama have said they expect compromise when making a deal to stop the $500 billion wave of higher taxes and automatic spending cuts from hitting the economy early next year.

But many on Wall Street are betting Congress will resort to its fractious ways before a deal is reached, and that could upset the stock market ? and holiday shoppers, particularly those at the high end.

?This is part of the thesis for some of us who are talking about a fourth-quarter slowdown,? said Daniel Greenhaus, global market strategist at BTIG. ?Part of that thesis is consumers are on the verge of seeing their taxes adjusted in January. Is it going to affect their behavior? As you get closer to Christmas, and spending accelerates, how much of that spending will be curbed??

There is a batch of consumer-related data in the coming week, most of it housing data, with home prices on Tuesday, new-home sales Wednesday and pending home sales on Thursday.

As housing has improved, so have consumer attitudes, but the impact of Super Storm Sandy could make data look temporarily weaker. Consumer confidence and durable goods are reported on Tuesday.

?It?s going to be all fiscal cliff. There?s going to be a lot of housing data, but there will be leaks and unconfirmed quotes, and how the conversations are going will matter,? said Greenhaus.

Black Friday, and in fact, late Thanksgiving Thursday, was the start of the Christmas holiday shopping season, and early reports were strong.

Wal-Mart said it had its best Black Friday events ever this year, starting at 8 p.m. ET Thursday. Between 8 p.m. and midnight Thursday, it said its stores rang 10 million register transactions and nearly 5,000 items per second.?

Stocks rallied Friday, the first positive Black Friday since 2008.

The Dow jumped 172 points, and was 3.4 percent higher for the week at 13,009, its highest close since election day. The S&P 500 jumped 3.6 percent for the week, to 1409, and the Nasdaq was up nearly 4 percent at 2966.

Consumer discretionary stocks were up 4.4 percent for the week, one of the best performers, and the sector was the best performer since the start of November, up 2.3 percent against declines in most other sectors. Chain stores will provide a look at the holiday sales in their November sales reports, expected to be released Thursday.

Dana Telsey, CEO and chief research officer at Telsey Advisory Group, said she expects holiday sales to be up 3.5 to 4 percent this year.

?If you have to say will it be better or worse than expected, it will be better,? she said, adding there are more ?must have? gifts at higher price points this year.

While Black Friday shopping is important, she said the real make-or-break period is the last 10 days before Christmas, which accounts for 40 percent of sales. The key day, then, is the second to last Saturday before Christmas.

The timing of that is just about when Congress should be in the throes of fiscal cliff talks, and it could be a dramatic time. Telsey said the way the talks are covered in the media could have an influence on shoppers.

?There?s much more effect on the high end,? she said.

Taxes are going to go higher for the wealthy, no matter what kind of deal is reached.

There is an automatic 3.8 percent tax, resulting from the Affordable Care Act, on investment income for those couples earning $250,000 or more, and another 0.9 percent tax on each dollar earned above that threshold. The 2 percent payroll tax holiday is expected to expire for all tax brackets.

?Everybody?s paycheck goes down 2 percent next year," said Greenhaus. "That really hits home.?

What?s not clear is whether the top tax rates will be raised, as sought by Democrats, or whether other revenue sources will be found, such as reduced deductions, a path suggested by some Republicans.?

The expected increase in capital gains and dividend taxes are still unknowns, but they have already hit some stocks. The dividend-paying utilities sector was the only negative major S&P sector this past week, down close to 1 percent, and it?s the worst performer since the beginning of November, down more than 8 percent.

Analysts are split on whether the market will be able to keep rallying, and they say whether there will be a ??Santa Rally? this year depends on Congress.?

Greenhaus said the uncertainty makes it impossible to predict the outcome, and therefore stock reaction. ?You just don?t know what form and what shape this takes,? he said. ?If it drags on as I expect it to, another five percent on the downside is a fair assumption."?

The news this month (Nov 2012) that Barclays bank has set aside an extra ?700m to cover claims for mis-sold payment protection insurance (PPI) has been welcomed by a leading UK debt management company.

The new money is in addition to the ?1bn set aside in 2011 and the ?300m in the first three months of 2012. The extra money was required due to Barclays? having received ?more claims than it had expected.?

Mr Kevin Fielder, of UK debt management company UK Money Solutions said this week ?We welcome this announcement from Barclays Bank. It is a further recognition of the scale of the mis-selling that took place and we hope it will speed up the claims process for those who have been victims of this scandal.?

PPI was supposed to protect customers who lost their jobs or became ill while repaying loans, but was widely mis-sold to those who did not want or need it. The extra money takes Barclays' provisions for PPI mis-selling to ?2bn and takes the total amount set aside across the industry to more than ?10bn.
