Microsoft catches a break: ITC remands Motorola case, Xbox 360 dodges at least a 2012 ban

Things were looking grim for gaming in April, when the International Trade Commission decided that the Xbox 360 violated Motorola patents and the console's US future was in doubt. The agency hasn't necessarily reversed its decision, but it just gave Microsoft a significant (and possibly permanent) reprieve. The Commission has remanded Motorola's case back to the Administrative Law Judge that gave the initial ruling, which very nearly restarts the clock: a new ruling won't come for months, and the usual review process guarantees even more of a delay even if the decision once more works in Motorola's favor. Patent suit watcher Florian Mueller is now confident that the Xbox 360 won't face any real risk of a ban in 2012, at a minimum. If the new decision doesn't clear Microsoft outright, it still pushes any ruling past a Microsoft lawsuit's trial in mid-November, when Motorola might be blocked from attempting any ban using its standards-based patents. We've rarely seen a majority or total reversal of this kind of ITC patent dispute before it reaches the appeals stage, but there's a distinct chance of that flip happening here -- especially as the ITC is using Apple's successful dismissal of an S3 Graphics victory as the judge's new template.

Cagle Post ? Discrimination Against LGBT Jurors Remains Legal

?Shocking.? That?s how California Judge Joan Weber described the actions of prosecutors who had dismissed a gay juror from the recent civil disobedience trial of several same-sex marriage advocates.

The incident was the latest example of potential jurors being removed from trials on the basis of their sexual orientation or gender identity.

Because California is one of the few states where such discrimination is illegal, Weber dismissed the entire jury panel. But in most state and federal courts, it?s legal to remove jurors simply because they are gay, lesbian, bisexual, or transgender.

Attorneys have two tools to create a jury. They can remove a juror for cause if the juror has an obvious bias. Attorneys are also given a limited number of peremptory strikes, which they can use to remove jurors who have no obvious bias.

Generally, attorneys don?t have to state a reason for a peremptory strike. But in the 1986 case of Batson v. Kentucky, the U.S. Supreme Court ruled that jurors could not be dismissed solely because of their race. Federal courts have extended Batson to cover other characteristics ? such as sex ? but have declined to include sexual orientation or gender identity.

In a 2005 appeal of the criminal convictions of two gay men from Minnesota, a defense attorney argued that a gay man was wrongfully dismissed from the jury. The 8th Circuit Court of Appeals ruled that the defense had failed to show discrimination had occurred and that even if it had, the prosecution?s actions likely weren?t illegal. ?[W]e seriously doubt Batson and its progeny extend federal constitutional protection to a venire panel member?s sexual orientation,? wrote the court.

That same year, a separate federal court upheld a transgender juror?s removal, observing that ?no federal law? prevents attorneys from removing ?cross-dressers or transvestites? from juries. (At trial, the prosecutor had explained that ?transsexuals or transvestites ? are more liberal-minded thinking people, tend to associate more with the defendants.?)

And in 2008, a Massachusetts court upheld a prosecutor?s removal of a juror based on the juror?s ?transgendered appearance.?

Even under the Obama administration, the Justice Department has declined to urge judges to bar discrimination against LGBT jurors.

In a case decided last year, a gay defendant challenged the dismissal of a potential juror who had indicated that she had a former ?domestic partner.? Federal prosecutors argued that sexual orientation was not the cause for her dismissal but nonetheless suggested reasons the court should be ?reluctant? to extend Batson to sexual orientation.

During oral arguments, 9th Circuit Judge Marsha Berzon brought up the Obama administration?s recently adopted position that stronger legal protections ? known as ?heightened scrutiny? ? should be applied to sexual orientation. Berzon suggested that this shift might make courts more likely to decide that sexual orientation should be covered under Batson. ?What,? asked Judge Berzon, ?is the government?s ultimate position? on the matter?

?I?m going to frustrate you, your honor,? responded Assistant U.S. Attorney Mark Yohalem, ?because the government?s ultimate position is that it takes no position on that.?

The court declined to decide whether removing jurors based on sexual orientation is legal.

Steve Rothman, a Democratic congressman from New Jersey, is looking to change that. In May, he introduced a bill that would prohibit jury discrimination in federal trials on the basis of gender identity or sexual orientation.

But Rothman?s bill may not become law anytime soon. A spokesperson for Texas Republican Lamar Smith, chair of the House Judiciary Committee ? where the bill currently awaits a hearing ? said that Smith has ?no plans to move the bill at this time.?

Similar legislation was introduced this year on the state level in Minnesota.

?This affects people?s lives,? says Scott Dibble, the state senator who introduced the bill. ?LGBT people provide important perspectives in terms of jury duty.?

Discrimination in jury service, argues Dibble, ?flies in the face of the values that all Americans share.?

LDR: Is the Relationship Worth the Distance? | Things Every College ...

You watch it on movies, you read it in books, you see it on TV shows, and you?re told to avoid it at all costs. The LDR, long distance relationship, is more or less frowned upon by basically anyone. College is the opportune time for a long distance relationship to either flourish or be flushed down the drain. But if you do find yourself in a long distance relationship, here?s some things you can do to help keep things going smoothly.

First off, you must understand that your long distance significant other?s schedule cannot revolve around yours. He is going to be experiencing college the same way you are. He is going to be learning new things, meeting new people, and experiencing all kinds of things that he?s never even thought of before. You have to give him time to do these things on his own. Just because you aren?t there doesn?t mean that he has to plan his entire day, week, and month around what you want him to be doing. It?s not fair to him that you have time to talk when he?s going to watch a game with his new friends.

Second off, it?s not fair to you for him to blow you off. He may not be able to talk between your class breaks, but he can sure enough set some time aside to chat with you. He also needs to allow you to experience college as well. You?ll be doing all kinds of new things as well, and if he?s not allowing you to do those things then that may be a sign of a control issue, which opens an entirely new can of worms.

Maintaining balanced communication is extremely important. Each of you has to put effort towards communicating and making things work. There are plenty of ways to make communicating and talking to each other easier. Skype is a great tool and is very useful when it comes to long distance relationships. It gives you the chance to actually see who you?re talking to. Because of this, you can both include each other in a lot of aspects of your new lives, such as showing each other your dorm rooms or other things. If you can?t use Skype, there?s always the classic phone call. It can be really comforting to hear each other?s voices. And of course, there?s text messaging which can be done throughout the day. Be careful not to rely on text messaging though. Short texts here and there are fine, but don?t try to have every conversation over text messaging.

Calling and texting your man are perfect ways to include him. But on a night out with the girls, it?s completely fine to leave him at home. You can tell him that you?re going out but leave him assured that there is nothing to worry about. When you do go out then, don?t drunk text him every 30 seconds. There?s nothing that will worry him more than you belligerently texting him. So while you?re getting ready, let him know that you and the girls are going to happy hour and tell him you?ll give him a call later. He?ll appreciate your call later more than he?d appreciate constant drunk texts.

Everyone likes surprises and there?s nothing wrong with sending a little surprise his way every so often. Obviously we?re all on a college budget, so it doesn?t have to be anything crazy. Sending him a little care package of his favorite candy or a ?Thinking of You? card is sure to make his day. It?ll show him that you care about him and are still thinking about him. In turn, you?ll make him feel better about the distance and this could make things a lot easier in the long run for you as a couple.

Long distance relationships are tough, there?s no doubt about that. But there are small things you can do to make sure he knows you?re thinking of him and that you care. Just keep in mind that school is more important than any boy. You are paying and going to college to get an education and a degree. If you?re relationship is taking away from your studies, you may want to re-evaluate how important you think that relationship is. The LDR isn?t necessarily as dreaded as it seems though, especially when that relationship is worth fighting for.

(AP) ? Jerry Sandusky's son Matt recalled showering with his future adoptive father as a boy and pretending to be asleep to avoid being touched ? memories that surfaced only recently, according to a police interview that details what are the earliest allegations yet of abuse by the former Penn State assistant football coach.

Matt Sandusky, now 33, said the abuse started at age 8, a decade before he was adopted by the once-heralded defensive coordinator, according to the interview, first reported Tuesday by NBC News.

"If you were pretending you were asleep and you were touched or rubbed in some way, you could just act like you were rolling over in your sleep, so that you could change positions," Matt Sandusky said in an excerpt played Tuesday on NBC's "Today" show. His attorneys confirmed the recording's authenticity to The Associated Press.

Jerry Sandusky was convicted last week of 45 counts of abusing 10 boys he met through the charity he founded ? the same organization that introduced him to Matt Sandusky, who became his foster child. Jerry Sandusky's principal lawyer did not return messages Tuesday, and another lawyer said only that Matt Sandusky's allegations contradict testimony he gave to the grand jury whose charges put his father on trial.

Matt Sandusky did not reveal any abuse when he was initially questioned as a grand jury witness but did release a statement alleging past abuse as the jury was sequestered in deliberations last week.

The police interview tapes are the first time Matt Sandusky's allegations of sexual abuse have been publicly aired, and too much time has passed for criminal charges. Asked why he was now coming forward on abuse purported to have occurred as early as the late 1980s, Matt Sandusky told police there were several reasons ? but singled out his family.

"So that they can really have closure and see what the truth actually is. And just to right the wrong, honestly, of going to the grand jury and lying," he said in the police interview.

The AP does not identify people alleging sexual assault without their consent. Matt Sandusky's lawyers named him in a statement released Tuesday to reporters that acknowledged the tapes' validity.

"Although the tape was released without Matt's knowledge or permission, it illustrates that he made the difficult decision to come forward and tell the painful truth to investigators despite extraordinary pressure to support his father," lawyers Justine Andronici and Andrew Shubin wrote.

Jerry Sandusky hasn't been charged with abusing Matt, one of six children adopted by the former coach and his wife, Dottie. Messages left for Sandusky's other children were not returned.

Matt Sandusky sat with Dottie Sandusky on the first day of the trial but left after hearing one of the accusers testify. His attorneys have said he reached out to them while the trial was under way, saying he wanted to talk to prosecutors.

Matt Sandusky said that he was undergoing therapy and that his memories of abuse were only now surfacing. He said on the tapes that he tried to flee Sandusky's house and also attempted suicide.

"I know that I really wanted to die at that point in time," he said.

On the recording, Matt Sandusky says he was sexually abused off and on between ages 8 and 15. While being questioned, he said Jerry Sandusky would blow raspberries on his stomach and touch his genitals. The acts described were similar to accounts relayed by eight accusers who offered graphic testimony on the witness stand.

Those eight accusers said they met Sandusky through The Second Mile, the charity Jerry Sandusky founded for at-risk youth. Matt Sandusky also met his adoptive father through the charity.

Asked whether he recalled engaging in oral sex or being raped by the former Penn State coach, he told police "at this point I don't recall that."

Unless he recovers memory of rape or deviate sexual intercourse, it doesn't appear Jerry Sandusky could still be charged in connection with the allegations by his son.

State Attorney General Linda Kelly said Friday after the verdict that the investigation was continuing. Matt Sandusky's abuse allegations date as far back as the late 1980s, about a decade before the allegations on which Jerry Sandusky was tried.

If the abuse ended by 1995, Matt Sandusky's deadline for pressing criminal charges appears to have expired in 2003 for rape or involuntary deviate sexual intercourse, and in 2000 for lesser sexual abuse, according to sex-crimes prosecutors.

Until 2002, Pennsylvania law allowed accusers to report the most serious charges of sexual abuse until age 23 and lesser charges until age 20. The law was then changed to give accusers up to age 30 to come forward for rape or involuntary deviate sexual intercourse.

The law was extended again in 2007 to age 50 for all sexual abuse claims. But the changes are not retroactive ? meaning Matt Sandusky would not be able to press criminal charges at this point.

On the civil side, Matt Sandusky may have missed his window for seeking damages from Penn State or others.

In Pennsylvania, accusers must now file lawsuits by age 30 in most cases, though exceptions are theoretically possible in the event of concealment or fraud.

"On the face of it, he's too late ... unless there's an exception around it," said lawyer Jeff Anderson, who filed the first lawsuit against Penn State over other Sandusky allegations. His client is not part of the criminal case because he came forward after the charges were filed.

Jerry Sandusky, 68, is under observation at the Centre County jail, where he has been separated from other inmates pending a psychological review to help determine the next step toward his sentencing in about three months. He has steadfastly maintained his innocence.

The son was prepared to testify against his father, lawyers have said. Defense attorney Joe Amendola has said that prosecutors told the defense that if Jerry Sandusky took the stand, Matt Sandusky would have been called as a rebuttal witness.

Another defense attorney, Karl Rominger, told the AP he and Amendola heard the tape before deciding not to put Jerry Sandusky on the stand.

He said that Matt Sandusky, on the tape, makes "allegations that directly contradicts sworn testimony ... directly contradicts police statements he'd given previously, directly contradicts public statements and absolutely contradicts everything his family knows."

Sandusky's arrest in November triggered a scandal at Penn State that led to the ouster of Hall of Fame coach Joe Paterno and the university's president.

The case has shone a national spotlight on the issue of sexual abuse against children. A spokeswoman for the Rape, Abuse & Incest National Network, which describes itself as the nation's largest anti-sexual violence organization said Tuesday there has been a 33 percent increase since the trial in the number of people who contacted the group's National Sexual Assault Online Hotline.

Rebel-held Syrian town struggles to keep the peace

(AP) ? The electrical supply merchant had barely arrived for work when the day's troubles began: Residents were complaining of fuel shortages, rebels had detained teenagers accused of robbing the high school and ? most alarmingly ? Shiite gunmen from a nearby village had kidnapped five Sunnis.

By mid-morning, a dozen men pensively sipped tea in Yasser Mamaar's shop, hoping the head of their town's revolutionary council would know what to do.

Puffing on a cigarette in a long, brown holder, the short, wrinkled, 55-year-old in a gray robe and matching sport coat made calls on an old green phone to find the missing men.

"There is no police station, there is no state, so who else can they go to?" said Mamaar, who now dispenses advice, mediates disputes and issues orders in addition to selling light bulbs, power cords and circuit breakers. "We have to solve people's problems."

The 15-month-old uprising that has pushed Syria toward civil war and left more than 14,000 people dead has also upended power structures in towns and cities across this country of 23 million. As the Syrian government focuses on holding major cities and battling a growing insurgency, many communities have been left to organize their own security and obtain enough food and fuel.

While massacres have raised fears of strife between Syria's religious sects, Mamaar, a Sunni Muslim, also works to calm tensions with his Shiite Muslim neighbors ? a task that gets harder every day.

Sectarianism is a rising force in the Syrian conflict, with a predominantly Sunni rebel movement fighting to topple President Bashar Assad's regime, which is largely led by members of his Alawite sect. Other minorities, like Shiites and Christians, have mostly stood by Assad, fearing for their place should he fall.

While dreaming of Assad's ouster, Mamaar's daily work serves a simpler goal: keeping chaos out of his town.

"As soon as there is chaos, the army comes, and as soon as the army comes, who will they kill? Our sons," Mamaar said.

So far, those efforts have brought a level of calm rare in Syria to this town where tractors outnumber cars, the produce market covers several blocks and families collect on their stoops at dusk while children run in the streets.

The revolt in Maaret Misreen started with small anti-regime demonstrations in April 2011. Residents mainly stood up against corruption and meddling by security services in many aspects of town life. Locals often say you needed security clearance to open a falafel stand. They are only partly joking.

"It was a dictatorial system, so they had to keep everything under their control," said activist Muhanad Aon.

Many suspected a local Muslim cleric, Abdel-Ghani Kassab, of being a regime mole planted to spy on residents. Kassab disappeared early in the uprising, only to return in December with a group of pro-regime fighters who then attacked local rebels, residents said. Mamaar's 22-year-old son, Tamer, was killed.

But the cleric and his fighters fled, and all other traces of the national government left soon thereafter. The rebels trashed the cleric's home, which now sits in mounds of rubble near a fountain painted with the revolutionary flag. Nearby graffiti reads: "The regime's house is a dump."

In March, the army shelled the city for two days, killing five people. Afterward, Mamaar helped negotiate a deal in which the rebels removed their checkpoints in exchange for calm. The army hasn't come back since.

"We worked hard to make that happen, and the village hasn't been ruined. So I feel we achieved something," said an opposition writer, Khatib Badli, who served as intermediary between the regime and the town. He also guessed that the army is easier on the town because about 15 percent of its residents are Shiite and it doesn't want to harm them.

Mamaar and his council do much of their work in his shop, its shelves cluttered with electrical outlets, switches, light bulbs and faucets. He has a ring of plastic chairs for the stream of visitors who gossip, tell him their woes, smoke cigarettes and drink the sweet tea he makes on a small gas stove.

Most of the problems one recent morning were relatively small: Rebels had detained some teenagers accused of stealing four computers, a TV, a satellite receiver and a water cooler from the high school; Mamaar was searching for witnesses. A widow complained that she couldn't find cooking gas; Mamaar said he'd replace her empty bottle.

The big issue, however, was the five men kidnapped by gunmen from the highway ? the latest in a string of tit-for-tat attacks between rebels and pro-regime gunmen from two Shiite villages east of town.

Such kidnappings have been going on for months, with scores from both sides held from a few hours to a few weeks. Some had disappeared: The Sunnis accused the Shiites of passing them to state security; the Shiites accused the Sunnis of killing them.

After writing down the missing men's names, Mamaar flipped through a book of handwritten numbers to decide whom to call.

But it's been getting harder to keep open those lines of communication. Mamaar used to drive to the Shiite villages to visit his contacts, he said. Now he rarely does.

When a farmer with a broken grain mill stopped to ask if he could take it to a repairman in a Shiite village, Mamaar told him no.

"If you go you now, you go at your own risk," he said.

The uprising has affected Mamaar's own views of Shiites in nearby villages. He regularly calls them "liars" and says the regime is arming them to work as shabiha ? pro-government thugs that violently suppress protests.

He also accuses them of being loyal to Iran, suggesting they would choose to go to that Shiite country if Assad falls.

"I think it's better if they don't stay in the area," he said.

Reached by phone, a prominent Shiite from one of those villages had some words of his own for those who oppose Assad.

"Those people aren't revolutionaries. They are troublemakers and traders in blood," said Zein al-Deen Taalib, 48.

He said many in his village of Fua served in the army and that they set up checkpoints for their own protection. He praised the Syrian army for doing its "sacred duty" and called Assad "the one real leader in the Arab world."

Echoing the regime line, he blamed the uprising on armed gangs backed by foreign powers trying to destroy the country.

"If I were a Sunni, I'd stand in the market in Maaret Misreen and kill them," Taalib said, noting that because he's a Shiite, a minority in Syria, he has to be more careful.

Many worry that violence between the communities will spread.

Badli, the opposition writer, said rebels were stepping up attacks on army and Shiite checkpoints.

"I don't think the army will let them get away with it for much longer," he said.

Another Shiite leader from the village of Kifarya who often speaks with Mamaar said all needed to work to maintain good relations. Before the uprising began last year, the two sects coexisted without violence.

"We'll try to keep it quiet so we can live together," said Abu Abdallah Hassaneh, 63. "As long as we are alive."

Shares of BlackBerry maker Research In Motion Ltd. dove to a nine-year low Monday. It comes as Morgan Stanley downgraded the stock, saying RIM's challenges are piling up.

Here's a look at recent developments as the company struggles to regain market share lost to the iPhone and Android devices:

Sept. 15, 2011: RIM reports a sharp drop in net income and revenue in the fiscal second quarter and says it has sold far fewer PlayBook tablet computers than it expected.

Oct. 10: Email and Internet services are disrupted for three days, primarily outside North America. RIM says a crucial link in its infrastructure had failed, and a backup didn't work either. By the third day, other users, including those in the U.S. and Canada, were affected by a backlog of traffic.

Oct. 25: RIM says it is delaying the launch of an upgraded operating system for the PlayBook until February, saying it isn't up to its standards yet. The company also says the new version initially won't have the popular messaging service BlackBerry Messenger. It's the third delay announced since the features were promised in April.

Dec. 2: RIM says it is writing off much of its inventory of PlayBook tablets after it had to sell them at a deep discount. The model originally priced at $500 now costs $200. The company says it's taking a pre-tax charge of $485 million in the just-ended quarter. RIM also says it will sell fewer BlackBerrys in the holiday quarter than in the one that just ended. Dec. 6: RIM says "BlackBerry 10" will be the new name for its next-generation system after the company loses a trademark ruling on its previous name, BBX.

Dec. 15: RIM says new phones deemed critical to the company's future won't be out until late 2012. The company says the BlackBerry 10 phones will need a highly integrated chipset that won't be available until mid-2012, so the company can now expect the new phones to ship late in the year. The company also says BlackBerry sales will fall sharply in the holiday quarter compared with the three months that ended Nov. 26. RIM says it would only ship between 11 million and 12 million BlackBerrys in the fourth quarter, down from 14.1 million in the third quarter.

'Dark Knight Rises': Batman Must Die

While comic book logic refuses to let major characters die, there's only one satisfying way to end this franchise, the Weekly Rising says.

Batman cannot die. Bruce Wayne laid that in clear language while riding on his jet with Alfred in "Batman Begins." "As a man, I'm flesh and blood. I can be ignored I can be destroyed, but as a symbol — as a symbol — I can be incorruptible, I can be everlasting."

That view was never considered a radical change in Christopher Nolan's revisionist take on the Caped Crusader. That's always been Batman's mindset.

Comic book logic, however, refuses to let any major character truly, permanently die, and the light air of previous film versions would never have taken the character that far and risk ending a successful film franchise. But ending a series is precisely what Nolan intends to do with "The Dark Knight Rises."

In the latest issue of Empire, the series' creators (Nolan included) discuss giving their story a definitive ending. And though such a finale is never expressly stated, one cannot help but walk away from the article believing that not only is it likely Bruce Wayne will die or retire at the end of "DKR," but that it's exactly what should happen.

A large portion of the lengthy article deals directly with the idea of Nolan ending his run of Batman films with a period instead of a more traditional and economically friendly ellipsis. This kind of move is unprecedented when dealing with a property as infinitely reusable as Batman. Jonathan, Nolan's brother and co-writer, told Empire that he feels a solid ending helps the functions of a storyteller.

"It's the right way to end it — to blow the whole thing up! It's better than trying to spin the thing out indefinitely and make it into the Bond franchise," Jonathan Nolan said. "I mean, they've successfully pulled it off with Bond, but at certain costs, certainly at the cost of continuity. I think with almost every other franchise it's a mistake to try and keep those plates spinning. You want stakes. You want tectonic plates to shift.
