Supreme Court sides with Idaho landowners against EPA

The Supreme Court strengthened the rights of property owners who are confronted by federal environmental regulators, ruling Wednesday that landowners are entitled to a hearing to challenge the government's threats to fine them for alleged Clean Water Act violations.

The 9-0 decision revolved around procedural matters and did not resolve questions about the reach of the act, which has been the subject of different legal interpretations.

But it is a victory for an Idaho couple, Mike and Chantell Sackett, who faced fines of up to $75,000 a day if they didn't restore a small wetland the Environmental Protection Agency said they had filled on a Bonner County lot where they planned to build their home.

When the Sacketts, who contended there were no wetlands on the property, sought to challenge the compliance order, they were told by EPA officials and later by a federal judge and the U.S. 9th Circuit Court of Appeals that they had no right to a hearing. Instead, they were told to comply with the order first and then seek a permit to resume building. They weren't entitled to a hearing until the agency had imposed a fine on them, the appeals court said.

Reversing the 9th Circuit, the high court concluded that the Sacketts had a right to sue the government at an early stage. The court did not rule on whether they had violated clean water regulations.

The couple were represented by the Pacific Legal Foundation, a property rights group. The EPA "can't order property owners to dance like marionettes while denying them any meaningful right to appeal to the courts," said attorney Damien Schiff, who argued the case. The agency "will have to change its enforcement techniques for the better," he said.

The EPA said it was reviewing the decision.

Vermont Law School professor Pat Parenteau said that he doubted the opinion would have much effect on Clean Water Act enforcement because it applied to "an extremely narrow range of cases" and that most people in similar situations complied with the agency orders.

"I think the court was certainly very concerned that EPA was telling people they had to ? pay all these fines but also saying, we're not going to tell you when, if ever, you're going to get a day in court," Parenteau said. "I think the court was right to call the EPA on that."

The Sacketts bought a parcel of less than an acre in 2005, intending to build a three-bedroom house. The lot is in a residential area near Priest Lake, and other houses had been constructed between their land and the lake. They obtained a county permit and trucked in dirt and gravel fill. A few months later the EPA informed them that their property contained wetlands and said they had violated clean water regulations.

"The EPA used bullying and threats of terrifying fines, and has made our life hell for the past five years," Michael Sackett said in a statement. "Now the Supreme Court has come to our rescue."

Wednesday's decision in Sackett vs. EPA gives the landowners a new tool for challenging the agency, but it does not change the law on what constitutes a wetland.

In a concurring opinion, Justice Samuel A. Alito Jr. faulted Congress and the EPA for not clarifying the definition of a wetland.

"Any piece of land that is wet at least part of the year is in danger of being classified by EPA employees as wetlands," Alito said. "Allowing aggrieved property owners to sue under the Administrative Procedure Act is better than nothing, but only clarification of the reach of the Clean Water Act can rectify the underlying problem."

Researchers at the University of Pittsburgh School of Medicine have identified a cell-signaling pathway that plays a key role in increasing insulin secretion during pregnancy and, when blocked, leads to the development of gestational diabetes. Their findings are available online today in Diabetes, one of the journals of the American Diabetes Association.

During pregnancy, pancreatic beta cells should expand and produce more insulin to adapt to the needs of the growing baby, explained senior investigator Adolfo Garcia-Ocana, Ph.D., associate professor of medicine, Division of Endocrinology and Metabolism, Pitt School of Medicine. Newborns can suffer complications if the mother's blood glucose is abnormally high during pregnancy, a condition known as gestational diabetes.

"Not much was known about the maternal mechanisms that lead to increased beta cell number and function during pregnancy," Dr. Garcia-Ocana said. "But research has shown that high blood glucose in pregnancy can have long-term health consequences for the child, as well as a greater risk of hypertension, type 2 diabetes, and high cholesterol for the mother."

His team began studying a protein called hepatocyte growth factor (HGF), which was discovered by George K. Michalopoulos, M.D., Ph.D., professor and chair, Department of Pathology, Pitt School of Medicine, in 1990. Blood levels of HGF are markedly increased in pregnancy. The protein interacts with a cell surface receptor called c-MET.

The researchers engineered mice that lacked the c-MET receptor in pancreatic cells and found that their beta cells functioned correctly, keeping blood glucose within normal parameters in adult mice. But when the mice got pregnant, they took on the features of gestational diabetes.

"Mice that didn't have the c-MET receptor in their pancreas had lower plasma insulin levels, higher blood glucose and impaired ability to regulate glucose levels," Dr. Garcia-Ocana said. "Without the receptor, they couldn't respond to HGF." Also, unlike normal healthy pregnant females, these mice didn't produce more beta cells, had more beta cell death and so had reduced beta cell mass.

"These findings provide the first direct evidence that HGF/C-MET signaling pathway has an important role in maternal beta cell adaptation during pregnancy," Dr. Garcia-Ocana noted. "Perhaps women who have a variation in the HGF gene or in the c-MET receptor are predisposed to developing gestational diabetes because they cannot adequately compensate for the increased insulin demands of pregnancy."

In future work, he and his team will explore HGF signaling in pregnant women, which could one day provide a new means of diagnosing, treating or preventing gestational diabetes.

A Fontana man has been charged with one count of conducting business as an uninsured employer.

In December 2011, members of the San Bernardino County District Attorney?s Office, Workers? Compensation Fraud Prosecution Unit, along with the Contractors State License Board, conducted compliance checks of contractors working in the Rancho Cucamonga area.? During the compliance check, Francisco Barajas-Castellanos, 30, of Fontana, and an employee were observed preparing the interior of a residence for painting.

According to Senior Investigator Steve Rivera, Barajas admitted that he was the contractor and business owner and that the employee was his employee.? Barajas further admitted not having workers? compensation insurance to protect his employee.

?Unfortunately, the problem here is that these unlicensed contractors can under-bid jobs, thereby having unfair advantage to those contractors who are licensed and have insurance,? said Rivera.

On March 15, Barajas was arrested at his residence after a warrant for his arrest was issued charging him with Failure to Secure Workers? Compensation Insurance.? He was transported and booked into the West Valley Detention Center and his bail was set at $10,000.

What a lot of homeowners don?t realize is that if a contractor does not have workers? compensation insurance, any injuries that occur on the homeowner?s property have now become the liability of that homeowner.

?If convicted, Barajas faces one year of prison time to be served in county jail and a fine starting at $10,000.? This case will be prosecuted by Deputy District Attorney Michael Chiriatti.

Smallest, oldest horned dinosaur gets a name

The oldest and smallest horned dinosaur in North America finally gets a name after decades of research.

The little horned dinosaur (Gryphoceratops morrisoni), measuring 1.6 feet (0.5 meters) long, lived about 83 million years ago.

The new study, published in the journal Cretaceous Research on Jan 24, also details another newly named species of horned dinosaur: Unescopceratops koppelhusae, which lived 75 million years ago in what is now Alberta, Canada.

"These dinosaurs fill important gaps in the evolutionary history of small-bodied horned dinosaurs that lack the large horns and frills of relatives like Triceratops from North America," study researcher Michael Ryan, curator at The Cleveland Museum of Natural History, said in a statement. "Although horned dinosaurs originated in Asia, our analysis suggests that leptoceratopsids (which includes these horned dinosaurs) radiated to North America and diversified here, since the new species, Gryphoceratops, is the earliest record of the group on this continent."

The first jaw fragment of U. Koppelhusaewas discovered in Dinosaur Provincial Park in 1995, but has just recently gotten a name; the other, G. morrisoni, was first discovered in 1950, but remained unnamed until recently. [Images of 'Triceratops' Ancestors]

The duo was much smaller than their larger Triceratops and Torosaurus relatives: U. koppelhusaemeasured about 6.5 feet (about 2 m) in length and weighed less than 200 pounds (91 kilograms). The researchers consider the other newbie, G. morrisoni, the smallest horned dinosaur in North America and one of the smallest plant-eating dinosaurs known.

Study researcher David Evans, associate curator at the Royal Ontario Museum said in a statement: "Small-bodied dinosaurs are typically poorly represented in the fossil record, which is why fragmentary remains like these new leptoceratopsids can make a big contribution to our understanding of dinosaur ecology and evolution."

Howard waives opt-out clause, staying with Magic

ORLANDO, Fla. (AP) ? Magic center Dwight Howard has finally put an end to the back-and-forth NBA roller-coaster ride that he had taken Orlando on for the past four months.

At least temporarily.

Howard's 11th-hour decision before Thursday's trade deadline to waive the early termination option in his contract means he has a deal with the only franchise he's known at least through next season.

"I'm glad this is finally over," Howard said at a news conference to announce the new pact. "...It's not as easy as some people think. It's been very hard. We're talking a career-changing event. Most people don't see that.

"I'm very loyal and I've always put loyalty above anything."

But loyalty only goes so far, the Magic wanted it in writing.

Had Howard not signed the papers, he would have been gone.

"It was real," Orlando general manager Otis Smith said of the possibility of dealing Howard before he signed the waiver. "We weren't rolling the dice."

But unless the Howard and the Magic can reach a long-term deal before next season begins, they're start right where they left off before Thursday. And it hasn't been pretty.

The Magic organization trudged through repeated closed door waffling on Howard's part about a desire to play with multiple teams and players, the city hosted an awkward All-Star weekend and pacifying a patient fan base.

Teammates have been frustrated and the situation has had an already intense Stan Van Gundy ready to blow a gasket having to answer ? or refusing to answer ? daily questions about Howard's status.

Even Howard's mother chimed in at one point during the drama, saying that she thought her son should remain in Orlando.

The saga continued until just hours before the trade deadline.

It was originally thought by both the Magic and league office that both Howard and agent Dan Fegan had to sign the forms. But turns out only Howard's signature was needed, opening the door for one more possible change of heart.

Though he had previously alluded to "getting bad advice" from people around him, Howard refused to touch the subject Thursday.

"It doesn't matter at this point," he said.

Howard said he didn't think he'd had a full night's sleep since making his original trade demand. He offered an apology to Magic fans for the back-and-forth ordeal, but not for taking his due diligence to make it.

"There's no decision about your life that you're gonna make in one day or one hour," he said.

But the four months it took Howard to make a decision impacted a lot of other people.

Howard first requested a trade during the preseason and at the time he expressed frustration with Magic management and what he felt was an unwillingness to include him in personnel decisions or to improve the roster around him. He went as far as to praise the relationship he felt All-Star Dirk Nowitzki has with Mavericks' owner Mark Cuban.

He maintained that stance until changing his mind this week and expressing a desire to remain in Orlando this season, though he initially refused to waive his opt-out provision.

Howard said he made his decision to waive the early termination clause in the hours after the Magic's loss to San Antonio Wednesday night and then notified the team via phone calls and text messages while on the team plane.

His teammates were apparently unaware of the final change of heart, with Magic guard Chris Duhon posting on his Twitter account "Off to Orlando and the waiting game begins" shortly after the Spurs' game.

But now Howard wants to put all that behind them.

Howard says he's "all in" now and ready to give the organization a full season to improve the roster going forward.

The Magic are 28-16 this season and seven games behind first-place Chicago. And despite everything Howard is averaging 21.2 points and a career-best 15.2 rebounds.

"Now we can get back to playing basketball and having some peace and trying to win a championship," said Howard. "I feel like we have a chance to win want and I didn't feel like either one of us (he or the organization) should give that up."

Howard said repeatedly Thursday he was both relieved and expressed a desire to make this a championship year for Orlando to make up for the off-court storms.

But with no long-term commitment how long the calm will last is certainly still an open proposition.

Unless Smith and Magic CEO Alex Martins can add pieces around Howard between now and the summer of 2013, this entire ordeal is set to play out one more time. Then there won't 'be an extra year to lean on.

The Magic didn't make player moves Thursday, but Smith said improving the roster and resigning Howard go hand-in-hand.

The Magic also would appear to have the advantage in signing Howard long-term because of provisions in the league's new collective bargaining agreement give the Magic the ability to offer Howard $30 million more than any other team if he becomes a free agent.

Orlando can offer him a five-year contract extension with 7.5 percent annual raises, while other teams are capped at offering a four-year pact with only 4.5 percent raises.

Martins, who has only been the Magic CEO since the preseason, said that part of the process was building a new relationship with Howard that he didn't have before.

Martins said his focus will be on making Orlando what Howard needs it to be in hopes of getting the center to sign a long-term deal.

But they can't come to an agreement, Howard could still be leaving Orlando ? just at a later date.

Martins said having experienced O'Neal walk away in 1996, like his GM, was going to put the Magic first no matter what.

"History plays a role in everything...and we were not going to suffer the same thing we did in the mid-90s," he said. "But if Dwight made a different decision, we were prepared.

"Loyalty is hard to find ... he's gotta be commended for the loyalty he's showing here."

Howard said his isn't concerned with the end of the next season.

"When the time comes we'll deal with it then," Howard said. "I have to put my trust in Alex and Otis...I want to win a championship and that's the only thing that matters."

Annan to brief deadlocked U.N. council on Syria

UNITED NATIONS (Reuters) - The U.N.-Arab League envoy on the Syrian crisis, Kofi Annan, will brief the U.N. Security Council on Friday about his peace mission, which diplomats say could breathe new life into stalled talks on a resolution aimed at ending the escalating violence.

Council diplomats say Annan's assessment of the crisis will be crucial to a bid by the United States and its European allies to pass a resolution that would also ensure humanitarian aid workers have access to besieged towns across the country. Russia and China have twice vetoed resolutions condemning Syria.

Talks between the five permanent Security Council members and Morocco on a draft resolution have stalled, but are expected to pick up again after Annan's briefing, diplomats said.

However, they say it remains unclear if Moscow will accept a resolution on Syria, where protests against President Bashar al-Assad began a year ago.

Russian Foreign Minister Sergei Lavrov told the Security Council during a special debate this week on the Arab Spring uprisings that Moscow would like the 15-nation body to reach consensus on a Syria resolution.

Russia, he said, could accept a resolution in line with its March 10 agreement with the Arab League, which urged an end to the violence, impartial monitoring, no outside interference, humanitarian access for all Syrians and support for Annan's push for talks between the government and the opposition.

A senior Western diplomat, speaking on condition of anonymity, said all those points were already covered in the U.S.-drafted resolution the five permanent members and Morocco have been discussing.

The main sticking points, he said, were Russia's insistence that the government and opposition stop fighting simultaneously and Moscow's push to assign equal blame to both sides. The United States, Gulf Arabs and Europeans say Assad's much-stronger and better-armed forces must stop fighting first.

"We are not going to accept a resolution that creates an equivalence between the regime and opposition," the diplomat said.

DEADLOCK

A less contentious, but still difficult issue is how to refer in the resolution to an Arab League plan that urges Assad to step aside, envoys said. Russia opposes clear endorsement of the plan, though Western diplomats said they could probably find an acceptable compromise Moscow and China could live with.

However, council envoys say there are no signs that permanent council members are close to breaking their deadlock. Negotiations on the resolution will likely remain on hold until after Annan's briefing on Friday, diplomats said.

Syria said on Wednesday it responded positively to proposals by Annan for ending the escalating violence that has killed thousands of civilians. Annan's spokesman had said questions remained over Syria's response.

The United Nations estimates Syrian security forces have killed well over 7,500 people. Syria said in December that "terrorists" had killed more than 2,000 soldiers and police.

Annan, a former United Nations secretary-general, will brief the U.N. Security Council via video conference. He met Assad in Damascus over the weekend and outlined proposals including a halt to fighting, humanitarian access and starting a political dialogue with the Syrian opposition.

U.N. Secretary-General Ban Ki-moon appealed to Assad on Monday to act within the next few days on peace proposals.

Russia, supported by China, has vigorously opposed action against Damascus by the 15-nation U.N. Security Council for more than six months.

The two veto powers have vowed to prevent Washington, Paris and London from pursuing Libya-style regime change in Syria, a strong ally of Moscow and home to the Russian navy's only warm-water port outside the former Soviet Union.

Diving in from the fringes | Support for Special Needs

I?ve spent a decade on the fringes of this community. I?ve read special needs parenting blogs, led IEP meetings in English and Spanish, trained special education teachers, and designed church programs to include families affected by disability. A couple months ago, I even wrote a post here about disability and faith.

But at the end of the day, I could choose to disengage from the world of disability if I wanted to. Sure, a couple of chronic health conditions remind me that I?m not fully in the community not affected by disability, but on good days I can even forget about those diagnoses.

I can go to a park with my kids and not look for ramps or other measures of handicapped accessibility, like I did yesterday.

I can visit a church for my nephew?s baptism without worrying much about how my children will respond to that new environment, like I did a couple weeks ago.

And at times, though I?m ashamed to admit it, I can ignore it when people throw around the r-word and other hurtful words to the disability community because it?s not as personal to me as it is for the parent of a child with special needs.

Or at least I could do all those things. My world is about to change. In a few months, we?ll be formally ushered from the fringes of this community by a little girl named Zoe Amanda when she becomes our daughter.

She lives in a children?s home in Taiwan. She was born in October 2011 at 30 weeks gestation ? ten weeks early ? to a single teenage mom who couldn?t care for her. She has several small areas of periventricular leukomalacia (PVL) in her brain. Three leading pediatric neurologists in the US agree that her eventual diagnosis will be cerebral palsy. She was exposed to alcohol in the womb as well, though she doesn?t have any diagnosis of FAS/FASD at this point.

Knowing that we were planning to adopt a child with special needs at some point and knowing that I often advocate for adoption on my disability ministry blog, a friend of mine contacted us about Zoe Amanda?s need for a family. We thought it was crazy to consider because the timing and her age and her country of birth and so many other factors were different from what we planned. Despite those reservations, we agreed to pray about it because our Christian theology affirms the importance of adoption and the value of people with disabilities. And after a few days of praying for her, we realized that we were no longer praying for an orphaned baby girl on the other side of the world.

We were praying for our daughter.

So now after a decade on the fringes of this community, we?re all in. I?ll be blogging about our adoption journey here once a month. And I?d love to learn from y?all. I know we?re na?ve about some of the changes our family will face. I?m sure we?ll feel ill-prepared at times regardless of how much advice we get, but I?d love any you have to offer.

After just ? few minutes, I stopped her, told her I appreciated her efforts, b?t th?t I just couldn't d? th?t t? her anymore. ?? th? very special friend she ??, she insisted ?n continuing; ?nd her suggestions proved invaluable. b?t ?t such ? cost!

I watched m? friend struggle with th? explanation ?f adding algebraic fractions with different denominators--an admittedly difficult skill f?r many people--all I could think about was t? wonder wh?t h?d made mathematics such ? negative force ?n her life. We h???, ?f course, discussed this issue many times, without ?n? good answers.

Reverend William E. Flippin, Jr.: Jesus Puts Business Out of Business

On this Third Sunday of Lent, we are in the midst of one of my favorite narratives in all of scripture coming from John 2:13-22. Like a no-nonsense consultant or maverick CEO, Jesus comes to work to provide a wake-up call. The mighty are about to fall.

John has this episode of Jesus tearing up the temple near the beginning of his gospel, while the synoptics describe it as occurring during the last week of Jesus' life before the crucifixion. The story is common to all four gospels, which would seem to indicate that it's a key event in the life of Jesus and the psyche of the early church. John's first readers would have known that the temple was already a smoking crater by the time they read his gospel, since it was destroyed by the Romans in A.D. 70. Jesus' words and actions were thus not only prophetic, but a stark reminder that any institution that claims to be of God is doomed to failure if it refuses to pay attention to God's own core purpose and values -- and what's going on in the shadows of the temple altar is symptomatic of a huge problem in temple worship.

Jesus launches "Occupy Temple" protests

By the time Jesus walked up to the temple that day, it was clear that it was a shell of its former glory and mission. Instead of being a holy place -- its core identity and function -- it had become a shopping mall, bank, government building and revolutionary symbol wrapped into one. The money changers and sellers made a profit selling sacrificial animals to the people, especially the poor (the mall); the treasury and records of debt were administered there (the bank), the high priest, who was a Roman appointee, and the scribal lawyers had their offices there (the government); and the zealots looked to it as a national symbol that, if it could be recaptured, could house a new government (the symbol). Every interest group saw the temple as the symbol of salvation, but none of these functions were going to save it or the people.

So Jesus walked right in and drove out the sellers, which effectively shut down the temple's sacrificial function for a brief time. Jesus was performing an acted parable, presaging in his actions the great going-out-of-business day to come. Jesus was occupying Wall Street, as it were. He announced a foreclosure on the temple but, like a passionate and visionary leader, announced that a new initiative would take its place. The temple would be destroyed, but a new one would be raised up: the temple of his own body (vv. 20-21). Jesus embodied God as the Word become flesh (1:14) and represented the very presence of God with his people -- especially those who were outside the temple establishment.

I wonder what Jesus would do if he were to walk through our church doors some Sunday morning and see our coffee bars with the sweetly flavored lattes, the merchandise we sell in our church stands and the clothes we wear there. Have we as African descent persons become so materialistic that we have turned what are supposed to be houses of prayer for the nations into dens of robbers and markets? Maybe it's not our dress codes that eliminate most of the de-churched and unchurched from feeling comfortable. Maybe the real robbery goes on deep inside our hearts: zeal for Jesus' Father's house often gives way to other things consuming or killing us spiritually, such as spiritual complacency. I rob God-and the church-and myself-every time I go to church to go through the religious motions rather than to meet God. During this liturgical season of Lent, I wonder what would we do to him if he were to start "moving furniture" around and cracking the whip? Jesus' actions and zeal to put business out of business reminds me of not too long ago while visiting Atlanta on its most famous street Peachtree that I was going down a one-way street, and I noticed somebody coming the other way. Obviously there was a problem. That car was going the wrong way. As I kept driving, I heard sounds all around me. After a while it became clear that all these chorus of voices were trying to get my attention, trying to confront me that I was wrong. You see, I thought stuff was wrong with everybody else, when the problem was with me. I suspected that there were two reasons for their concern. One is the damage that I could do to myself. The other is the damage I could do to others. They could have simply ignored it and said, "That's his business." Or, they could do what they did, which is try to get my attention, because they understood that when you're going the wrong way, somebody needs to confront you, so that you can reverse your direction. In this passage, Jesus gets our attention and teaches us lessons that show us that he puts business out of business such as greedy corporations and even the exploitative nature of the institutional church. As a Lutheran (ELCA) that is my interpretation of Martin Luther, the German Reformer actions of protest when he nailed the Ninety-Five Theses at the Church at Wittenburg.

Jesus' temple action challenges us to look within our own churches to determine whether we're being faithful to his call, or whether God's prophetic confrontation is merited for misinterpreting what the church should be.

- Do we measure the church's success in ways that cause us to have hubris rather than humility? Are we so enamored with our own attendance figures, buildings, high-tech gadgets, myriad programs and charismatic leaders that we fail to question whether we're doing what Jesus wants?

- Are we caught up in the undisciplined pursuit of more -- more people, more facilities, more money, more everything -- that we equate bigness with success? Are we growing the institution at the expense of making disciples one person at a time?

- Do we avoid the risk of being prophetic and challenging people with the gospel of the kingdom, and instead placate them with pithy quotes, feel good theology and gimmicks popular for the times? Do we blame the secular culture, the economy, the government or any other outside force for our decline?

- Are our churches grasping at speedy fixes -- new programs, charismatic leadership, and better coffee -- that will turn everything around quickly?

- Does the church have a spirit of hope or a spirit of defeat?

All of these are warning signs that the church is going out of business. The only way back is to allow Jesus to come in and clean house, making him the center of our worship and our mission.

If Jesus were to come into African descent communities of faith, what would he want to drive out in order to accomplish his purposes through you? What practices or programs or perceptions do you need to discontinue in order becoming the incarnate Body of Christ in your community?
